In our monthly Due Diligence Monitor we discuss current due diligence issues in hedge funds and alternative investment vehicles. This month we look at litigation as a potential risk to investors and counterparts. 

In any proper due diligence process the topic “litigation” should be very high on the agenda. We mean by litigation any legal proceedings in a court of law, but also any actions by a federal agency, a supervisory body or similar, ranging from civil, administrative, regulatory to criminal cases. This can have the form of an investigation or any other controversy leading to a proper litigation or prosecution.
